 पीटीआई, बेंगलुरु। ईडी ने कर्नाटक के मुख्यमंत्री सिद्दरमैया और अन्य से जुड़े मुडा जमीन आवंटन मामले में लोकायुक्त पुलिस द्वारा दायर क्लोजर रिपोर्ट को चुनौती दी है। ईडी ने मंगलवार को एमपी, एमएलए स्पेशल कोर्ट के समक्ष लोकायुक्त पुलिस के खिलाफ विरोध याचिका दायर की, जिसमें कहा गया कि वह इस मामले में पीड़ित पक्ष है।

याचिका में पीएमएलए-2002 के उद्देश्यों और कारणों का हवाला दिया

केंद्रीय एजेंसी ने अपनी याचिका में पीएमएलए-2002 के उद्देश्यों और कारणों का हवाला दिया, जिसमें कहा गया है कि दुनिया भर में यह महसूस किया जा रहा है कि मनी लांड्रिंग न केवल देश की वित्तीय प्रणालियों के लिए बल्कि उनकी अखंडता और संप्रभुता के लिए भी गंभीर खतरा है।

पुलिस द्वारा दायर क्लोजर रिपोर्ट पर कही ये बात

ईडी ने कहा कि देश मनी लांड्रिंग अपराध के पीड़ित की परिभाषा के अंतर्गत आता है। इसने आगे कहा कि एजेंसी को एक पीड़ित व्यक्ति के रूप में माना जाना चाहिए, क्योंकि वे मनी लांड्रिंग निवारण अधिनियम के तहत अभियोजक हैं और इस प्रकार जांच एजेंसी को लोकायुक्त पुलिस द्वारा दायर क्लोजर रिपोर्ट पर कोई आदेश पारित करने से पहले विरोध करने या सुनवाई करने का अधिकार या अधिकार है।

गौरतलब है कि मैसूर शहरी विकास प्राधिकरण (मुडा) जमीन आवंटन मामले की जांच कर रही लोकायुक्त पुलिस ने उल्लेख किया था कि सुबूतों के अभाव में सीएम सिद्दरमैया और उनकी पत्नी पार्वती के खिलाफ आरोप साबित नहीं हो सके।

क्लोजर रिपोर्ट हाई कोर्ट को सौंप दी है

जांच अधिकारियों ने कहा कि उन्होंने क्लोजर रिपोर्ट हाई कोर्ट को सौंप दी है। इस मामले में सीएम सिद्दरमैया और उनकी पत्नी पार्वती के अलावा उनके साले और जमीन के मालिक देवराजू भी आरोपित हैं।

हाई कोर्ट ने दी ईडी जांच की अनुमति

कर्नाटक हाई कोर्ट ने ईडी को मुडा जमीन आवंटन मामले में पूर्व एमयूडीए आयुक्त डीबी नटेश को छोड़कर सभी आरोपितों की जांच करने की अनुमति दे दी।

मुख्य न्यायाधीश एनवी अंजारिया और जस्टिस केवी अरविंद की खंडपीठ ने फैसला सुनाया कि ईडी कानून के अनुसार अन्य आरोपित व्यक्तियों के खिलाफ जांच आगे बढ़ाने का हकदार है। इससे सीएम सिद्दरमैया की मुश्किलें बढ़ सकती हैं।

पीठ के आदेश पर रोक लगाने के लिए खंडपीठ का दरवाजा खटखटाया

ईडी ने एकल न्यायाधीश की पीठ के आदेश पर रोक लगाने की मांग करते हुए खंडपीठ का दरवाजा खटखटाया था। दूसरी ओर, मुडा घोटाले की जांच सीबीआइ को सौंपने की स्नेहमयी कृष्णा की याचिका खारिज कर दी गई।

आइएएनएस, बेंगलुरु। गोकर्ण स्थित श्री रामचंद्रपुरा मठ के श्रीमद जगद्गुरु शंकराचार्य श्री श्री राघवेश्वर भारती स्वामी के खिलाफ दुष्कर्म के मामले को खारिज करते हुए कहा कि कथित घटना की शिकायत करने में नौ वर्ष की देरी को लेकर शिकायतकर्ता के पास कोई सही स्पष्टीकरण नहीं था।

मठ की एक पूर्व शिष्या ने आरोप लगाया था कि 2006 में 15 वर्ष की आयु और फिर 2012 में 21 वर्ष की आयु में हिंदू संत ने दो बार उसके साथ दुष्कर्म किया।

स्वामी ने एक ट्रायल कोर्ट द्वारा इस संबंध में की गई पूरी कार्यवाही को चुनौती देते हुए इसे रद करने की मांग संबंधी एक याचिका 2021 में हाई कोर्ट के समक्ष दायर की थी। जस्टिस एम नागप्रसन्ना की पीठ ने इस संबंध में आदेश जारी किया।

याचिकाकर्ता के खिलाफ पूरी कार्यवाही प्रभावित

आदेश में कहा गया कि आरोप पत्र को लेकर बेंगलुरु के प्रथम अतिरिक्त मुख्य मेट्रोपालिटन मजिस्ट्रेट के समक्ष लंबित कार्यवाही समेत सभी कार्यवाही को रद किया जाता है।

आदेश में कहा गया कि याचिकाकर्ता के खिलाफ पूरी कार्यवाही प्रभावित है। मामले में आगे के ट्रायल की अनुमति देना निस्संदेह कानूनी प्रक्रिया का दुरुपयोग होगा और न्याय की विफलता होगी। इस मामले में मजिस्ट्रेट द्वारा दिमाग का इस्तेमाल नहीं किया गया।

महिला ने स्वामी जी पर लगाए गंभीर आरोप

आरोप-पत्र सीआइडी अधिकारी ने दाखिल किया है, जिसे इसका अधिकार नहीं था। शिकायतकर्ता ने आरोप लगाया था कि 2006 में स्वामी जी ने अपने कमरे में भगवान का डर दिखाकर उसका यौन उत्पीड़न किया और किसी को बताए जाने पर पाप लगने की बात कही। इसके बाद स्वामी जी द्वारा मठ के ही एक सदस्य से उसकी शादी तय कर देने के बाद उसके साथ दुष्कर्म किया गया।

The firm set price targets of ₹1,902 for Waaree and ₹693 for Premier, implying downsides of 16% and 22% over Wednesday's closing prices."We initiate at underperform considering where we are in the cycle, our expectation of deterioration in returns and their rich valuations," said Bernstein in a client note. "One cannot give the same multiple to a business built on the premise of a regulatory arbitrage."Waaree shares fell 4.2% to ₹2,279.8 and Premier declined 2.2% to ₹889.8 on Wednesday.Bernstein said Waaree and Premier face the risk of deep-pocketed bigger groups entering the space. "We think this will eventually be a place for the big players with backward integration - Reliance, Adani Enterprises etc.- to lead," said the brokerage. "While Waaree does show the potential to join this league, and is rightly exploring avenues beyond the module-cell, we think the key competitors have much bigger wallets to compete.""It's too early to dismiss them, but at the valuations they trade it - we think it already prices in them joining the big boys club."
